I. The Patent Application Process

(1) Patent Application Document Preparation: The completion and drafting of patent application documents have specific requirements. Applicants may fill out or draft them themselves, or entrust a patent agency to handle the matter on their behalf.

(2) Accepted

Upon receiving a patent application, the Patent Office Reception Desk or any Patent Office Sub-agency will, for applications meeting the acceptance criteria, determine the application date, assign an application number, and issue an acceptance notice.

Patent Approval Process

Under the Patent Law, the approval process for a patent application includes five stages: acceptance, preliminary examination, publication, substantial examination, and authorization. Applications for utility models or design patents do not undergo publication and substantial examination during the approval process; they only have three stages: acceptance, preliminary examination, and authorization.

Two: Documents required for applying for an invention patent

(1) Petition: Including the name of the invention patent, the names of the inventor or designer, the names and addresses of the applicant.

(2) Instructions: Including the name of the invention patent, the technical field it belongs to, the background technology, the content of the invention, explanations of the attached drawings, and specific implementation methods.

(3) Claim of Right: Describes the technical features of the invention, clearly and concisely stating the content to be protected.
