Patent Application and Patent Transfer

Patent application is a mandatory procedure for obtaining patent rights. To acquire patent rights, the applicant must file a patent application with the national patent authority, which is then approved and a certificate is issued. When submitting a patent application to the national patent authority, the applicant should submit a series of application documents, such as a request form, description, abstract, and claims, among others. The applicant can either file the application themselves or seek assistance from a patent agency.

Patent transfer is a legal act where the applicant and the patentee assign their patent application rights and patent rights to others. According to the "Patent Law of the People's Republic of China": The rights to apply for a patent and the patent rights may be transferred.

The patent transfer process requires a period of 2 months.
