Patent Application and Patent Transfer

Patent application is the necessary procedure to obtain patent rights. To acquire patent rights, the applicant must submit an application to the national patent authority, which is then approved and a certificate issued. When applying for a patent with the national patent authority, the applicant should submit a series of application documents, such as the application form, description, abstract, and claims, among others. They can either apply themselves or hire a patent agency.

Patent transfer is a legal act where the applicant and the patent holder assign their patent application rights and patent rights to others. According to the Patent Law of the People's Republic of China, patent application rights and patent rights may be transferred.
